1Introduction

Welcome to GoCrazyAI ("GoCrazyAI", "we", "our", or "us").

These Terms of Service ("Terms") govern your access to and use of our website, applications, and AI-powered services (collectively, the "Services"). By accessing or using GoCrazyAI, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2Description of Services

GoCrazyAI provides AI-powered tools that enable users to generate digital content based on user input, including but not limited to:

• AI-generated images
• AI-generated videos
• AI-generated audio or music
• AI-assisted creative media

All outputs are generated algorithmically based on user-provided prompts and inputs. GoCrazyAI does not guarantee the availability of any specific model, feature, or output format.

3Eligibility & Age Requirement

By using the Services, you represent and warrant that:

• You meet the minimum age requirement
• You have the legal capacity to enter into a binding agreement
• You are using the Services in compliance with applicable laws

We reserve the right to suspend or terminate accounts suspected of underage use.

4User Accounts

Some features require account registration. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us promptly of any unauthorized access

We are not liable for losses resulting from unauthorized account use.

5Subscriptions, Credits & Payments

5.1 Billing

• Paid plans are billed in advance on a recurring basis
• Subscriptions renew automatically unless canceled prior to renewal
• Pricing and plan features may change with reasonable notice
• Charges will appear as GOCRAZYAI or USPEH LABS LLC on your bank or card statement

5.2 Refund & Cancellation Policy

• Credits are non-refundable. Once purchased, credits cannot be refunded, transferred, or exchanged for cash.
• Cancel anytime. Subscriptions can be cancelled at any time from your account settings.
• Access until end of billing period. After cancellation, you will retain full access to your subscription benefits until the end of your current billing period.
• No partial refunds. We do not issue partial refunds for unused portions of a billing period.
• Technical exceptions. If a system error on our end causes credits to be deducted without delivering content, we will investigate and may restore the affected credits.

6AI Output & Variability Disclaimer

You acknowledge and agree that:

• AI-generated content is probabilistic and non-deterministic
• Outputs may vary, contain imperfections, or differ from expectations
• No guarantee is made regarding accuracy, realism, suitability, or fitness for purpose

7Content Ownership & License

7.1 User Content

• You retain ownership of content you upload and generate
• You grant GoCrazyAI a limited, non-exclusive license to process content solely to provide the Services

7.2 Platform Content

All platform software, interfaces, branding, and non-user content remain the exclusive property of GoCrazyAI and are protected by intellectual property laws.

8Usage Rights & Restrictions

Unless explicitly stated otherwise:

• AI-generated content is provided for personal use
• Commercial usage rights may vary by plan or feature
• Users are solely responsible for verifying usage rights before external or commercial use

GoCrazyAI makes no representations regarding copyright, trademark, or third-party rights in generated content.

8.1 AI-Generated Voice & Likeness Content

All public-figure-inspired voices available on GoCrazyAI are AI-generated imitations. They are not affiliated with, endorsed by, or associated with any real individual. These voices are provided solely for parody, commentary, and personal entertainment purposes. Users are solely responsible for ensuring their use of generated content complies with all applicable laws, including intellectual property, right-of-publicity, and defamation regulations. Commercial use of content featuring public-figure likenesses may require separate authorization from the relevant rights holders.

9Prohibited Uses

• Any unlawful purpose or in violation of any applicable laws
• Creating content that infringes upon third-party rights
• Creating content that is defamatory, obscene, or offensive
• Impersonating individuals without consent
• Creating deepfakes, non-consensual synthetic media, or misleading content that could deceive, defame, or harm any individual
• Attempting to gain unauthorized access to our systems
• Engaging in any activity that disrupts or interferes with our services
• Circumventing safeguards or abusing system limits

10Consent & Likeness Responsibility

You are solely responsible for ensuring that:

• You have rights or consent to upload any images or likenesses
• Generated content does not violate privacy, publicity, or personality rights
• Outputs are not presented as factual or misleading representations of real individuals

GoCrazyAI does not verify user-provided rights or permissions.

11Monitoring & Enforcement

• GoCrazyAI does not conduct routine human review of content
• Automated systems may be used to enforce safety and integrity
• We reserve the right to investigate violations and take action
• We may cooperate with lawful authorities when legally required

12Termination

We may suspend or terminate your access at any time, with or without notice, if:

• You violate these Terms
• Your use poses legal, security, or reputational risk
• Required by law, payment providers, or infrastructure partners

13Disclaimer of Warranties

We disclaim all warranties, express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Availability or error-free operation

Use of GoCrazyAI is at your own risk.

14Limitation of Liability

To the maximum extent permitted by law:

• GoCrazyAI and its owners, employees, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our website or services. Our total liability for all claims related to the services shall not exceed the amounts paid by you for the services during the 12 months preceding the claim.

Some jurisdictions do not allow certain limitations; rights may vary.

15Indemnification

You agree to indemnify and hold harmless GoCrazyAI, its founders, affiliates, and partners from claims arising from:

• Your use of the Services
• Your generated or shared content
• Your violation of these Terms or applicable laws

16Third-Party Services

GoCrazyAI relies on third-party infrastructure and AI providers. We are not responsible for:

• Third-party service interruptions
• External policy changes
• Third-party terms or limitations

17Changes to These Terms

We may update these Terms from time to time.

• Continued use constitutes acceptance of revised Terms

18Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

19Dispute Resolution & Arbitration

19.1 Informal Resolution

Before initiating any formal dispute proceeding, you agree to first contact us at go@gocrazyai.com and attempt to resolve the dispute informally for at least thirty (30) days. Most concerns can be resolved quickly through direct communication.

19.2 Binding Arbitration

If we cannot resolve a dispute informally, you and GoCrazyAI agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding individual arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.

• Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
• Arbitration shall take place in New Castle County, Delaware, or remotely at your election
• The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction

19.3 Class Action Waiver

You and GoCrazyAI agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against GoCrazyAI.

19.4 Chargebacks

You agree to contact us before filing a chargeback or payment dispute with your bank or payment provider. Filing a chargeback without first attempting to resolve the issue directly with us may result in immediate account suspension and forfeiture of any remaining credits or subscription benefits.
